1. Seller and contact

Benii is published and sold by:

Antoine Vaillant, sole trader (entrepreneur individuel, EI), trading name Benii

SIRET: 851 180 570 00026

Address: 72 rue de la République, 02300 Bichancourt, France

Email: support@benii.app · Phone: +33 6 65 67 85 06

VAT not applicable, article 293 B of the French General Tax Code (CGI)

In these terms, “we” means the seller and “you” means the user. The other legal information is set out in the legal notice.

2. Acceptance and language

By using the Service, you accept these terms. When subscribing on the web, you expressly accept them by ticking the box provided on the payment page, before paying. When purchasing in the App Store (Apple) or on Google Play (Google), these terms apply in addition to the terms of those platforms.

The terms applicable to a subscription are those in force on the day of subscription, subject to article 19. Translations are provided; in case of any difference, the French version prevails.

3. The Service

Benii is a personal and shared budget management application: recording expenses and income, money left to live on, budget shared with other people (household), subscription tracking, savings goals, spending analysis, import of a bank statement in CSV format and data export.

Benii is available on iPhone and iPad, on Android and on the web (benii.app/app). Without an account, your data is stored only on your device. With an account, it is also synchronised on our servers, hosted in the European Union (Frankfurt, Germany).

Benii is a tool to help you get organised. It does not provide any financial, tax, banking or investment advice, and does not make any payment or transfer on your behalf. Direct connection to a bank account is not offered at this time.

4. Account

5. Free plan and Benii Premium

Free plan

The free plan has no time limit, requires no bank card and has no ads. It includes in particular: 1 budget (which can be shared), money left to live on, real-time shared budget, subscription tracking, 1 savings goal, analysis of spending over the last 2 years, trends as soon as you have 3 months of history, quick add, including voice input and receipt scanning (with an account, within a daily scan limit intended to prevent abuse), CSV import and CSV export.

Benii Premium

Benii Premium adds, for the whole duration of the subscription:

Features announced as “coming soon” are not part of the subscription until they are available and are not taken into account in its price. The end of the subscription does not erase your transactions: only the Premium features become inaccessible.

6. Prices and payment

VAT not applicable, article 293 B of the French General Tax Code (CGI): the prices above are the total prices payable, with no VAT on top.

7. 7-day free trial

8. Automatic renewal

9. Cancellation

You can cancel at any time, free of charge and without giving a reason. Cancellation stops the renewal: Premium remains active until the end of the period already paid, then stops. The current period is not refunded, except under the right of withdrawal (article 11) or the legal guarantee (article 12).

Please note: uninstalling the application or deleting your Benii account does not stop a subscription taken out with Apple or Google. Only Apple and Google can cancel it, from your settings.

10. Price changes

We may change the price of Benii Premium for future periods. Any increase is announced to you by email or in the application at least 30 days before it applies; it only applies from the renewal following this notice period, never to a period already paid. You can cancel free of charge before that date. On the App Store and Google Play, Apple and Google also notify you and may ask for your consent; without consent, the subscription stops at the end of the current period.

11. Right of withdrawal

11.1 Subscription taken out on the web (Stripe)

Refund:

11.2 Subscription bought in the App Store or on Google Play

These purchases are collected by Apple or Google, who manage withdrawal and refunds themselves according to their own terms. We cannot directly refund a purchase made with them. Make your request to Apple (request a refund from Apple) or to Google (Google Play refunds). We can help you: support@benii.app.

12. Legal guarantees and liability

Legal guarantee of conformity

As a consumer, you benefit from the legal guarantee of conformity for digital content and services (articles L224-25-12 and following of the French Consumer Code). For a subscription, it covers any lack of conformity that appears throughout the period during which the service is supplied. In the event of a defect, write to support@benii.app: you are entitled to have the service brought into conformity, free of charge and within a reasonable time; failing that, or if the defect is serious, to a price reduction or to termination of the contract with a refund. These rights are in addition to any commercial guarantee and cannot be excluded.

Availability

We do what is necessary for the Service to work properly and continuously. Interruptions may occur for maintenance or security reasons; we keep them to what is strictly necessary. If an interruption or a defect deprives you of Premium, the legal guarantee above applies.

Liability

13. Referral

14. Shared budgets and shared Premium

15. Account deletion and closure

16. Acceptable use

You undertake to use Benii fairly: do not attempt to access accounts or servers without authorisation, do not disrupt the operation of the Service, do not use it for illegal purposes, and respect the other members of your shared budgets as well as the support team.

17. Intellectual property

The Benii name, logo, design, texts and code of the Service belong to the publisher. We grant you a personal, non-exclusive and non-transferable right of use, for as long as you use the Service. The data you enter remains yours; you only authorise us to process it to operate the Service.

18. Personal data

The processing of your data is described in the privacy policy.

19. Changes to the terms

We may change these terms, for example to follow a change in the Service or in the law. Any significant change that concerns your subscription is announced to you by email or in the application at least 30 days before it takes effect; it does not apply to the period already paid and you can cancel free of charge before that date. The date of the last update is shown at the top of the page.

20. Complaints and mediation

For any complaint, first write to support@benii.app or by post to the address in article 1; you can also use the Support page.

If the disagreement persists after this written complaint, you can refer the matter free of charge to the following consumer mediator (articles L612-1 and following of the French Consumer Code), no later than one year after your complaint:

Société Médiation Professionnelle

Address: 24 rue Albert de Mun, 33000 Bordeaux, France

Website: www.mediateur-consommation-smp.fr

Mediation is conducted in French.

The European online dispute resolution platform was closed by the European Union in July 2025. For a dispute with a trader in another EU country, you can contact the European Consumer Centre France (www.europe-consommateurs.eu).

21. Applicable law

These terms are governed by French law. If you live in another country of the European Union, you keep the protection of the mandatory rules of the law of your country. In the event of a dispute, you can bring the matter, as you choose, before the court of the place where you lived at the time of the subscription or when the damage occurred, or before any other court with jurisdiction under the law.
